Angela Kase writes about subcontractor protection in connection with the new public procurement law
In the latest issue of Juridica, lawyer Angela Kase of RASK Attorneys-at-Law and legal counsel Dr Mari Ann Simovart of COBALT analyse the legal ambiguity of the issue of subcontractor protection in the new Public Procurement Act.
The authors discuss whether the regulation on the suspension of payments coming into force on 1 January 2019 is in line with the general principles of the public procurement law, and whether such a regulation can be effectively implemented in the context of Estonian law.
Small and medium-sized enterprises play an important role in the Estonian economy, which in turn makes it necessary to shape procurement rules in such a way that such companies are more involved in the procurement market. Whether the new public procurement act will fulfil this role or punish businesses instead of protecting them is up for a debate.
