Keidi Kõiv explains in Ärileht how risks should be distributed in public procurements in the construction sector
In an article published on 17 January in business news site Ärileht, Keidi Kõiv, RASK’s Head of Public Procurement, explains what kind of changes and considerations contracting authorities should make in their procurement practices in the market conditions that define today’s construction sector.
“Contracting authorities have an extensive duty of care in the preparation and execution of public procurements. The core principle is that the contracting authority draws up procurement conditions based on the actual market situation and predicts the expected cost of the procurement contract. Essentially, this means that the contracting authority should assess the possible risks in the performance of the contract and mitigate them where possible by establishing appropriate conditions,” Keidi Kõiv writes in the article.
