Construction and real estate law is one of RASK’s core areas of expertise, covering representation across all stages of development and sectors. RASK has advised on numerous commercial real estate projects – from entering into investments and managing ongoing operational matters to exiting major investment funds and real estate developments. Our real estate lawyers provide comprehensive support throughout the entire real estate lifecycle, from the initial planning of a development project to the preparation of real property agreements, building permits, and lease agreements.

RASK has extensive experience across a wide range of real estate segments, including new developments, retail properties (EfTEN), Class A office buildings (Skyon), healthcare facilities (Qvalitas and Unimed), hotels (Courtyard by Marriott Tallinn) and accommodation facilities, industrial and logistics real estate, PPP projects, embassy buildings, and complex heritage protection sites. We advise on both contractual sales agreements and limited property rights, including servitudes, personal rights of use and mortgages. Our practice also covers the full scope of land registry-related procedures.

RASK’s real estate law experts are actively involved in the drafting of design and construction contracts, ensuring contractual balance and the protection of clients’ interests. In addition to construction law matters, we advise on design processes, development structuring and preparations for the sale of real estate assets.

In real estate transactions, we conduct thorough legal due diligence and assess development risks, and analyse financing structures, including legal aspects related to landlord’s liens and mortgage enforcement.

We act as legal partners to major players in the construction sector, assisting with construction disputes, procurement matters, planning concerns and corporate governance-related questions, including employment relations and the engagement of foreign labour. We also represent clients in lease disputes and advise on all legal matters related to lease agreements.
