Matrimonial Property Regimes and Marital Assets


A well-considered property regime helps avoid future disputes and protects both personal assets and business continuity. We advise clients on choosing a property regime in accordance with the Family Law Act and the Registered Partnership Act, draw up prenuptial and postnuptial agreements, and help clearly delineate joint and separate property, so that personal assets, business shareholdings, investments and other property are clearly defined.


In the absence of a marital property agreement, all joint property is divided upon divorce. This is why financial matters are worth thinking through before marriage – alongside its personal significance, marriage also has an important legal and financial dimension.

Divorce, Child Custody and Child Maintenance


Divorce often affects both property and children's futures at the same time. We help clients throughout the entire divorce process – from filing the divorce petition to dividing marital property, valuing businesses and resolving matters relating to business shareholdings.


In matters of child custody, contact arrangements and maintenance, we seek solutions that put the child's best interests first and provide clarity in the longer term. Succession planning helps ensure that assets pass on in accordance with the deceased's wishes, retain their value and carry a lower risk of future disputes. We advise clients on drawing up wills and inheritance contracts, on the rights and obligations of executors, and represent clients in inheritance disputes.


Situations where the estate includes businesses, real estate, investments or assets in several countries require particular attention. In such matters, we combine our knowledge of family law, inheritance law and business law to protect both the value of the assets and their smooth transition to the next generation.
