Successful Representation of Introduct Estonia OÜ in an Employment Dispute

Case

RASK Attorney-at-Law Keidi Kõiv successfully represented Introduct Estonia OÜ in an employment dispute with a former employee, challenging a decision of the Labour Dispute Committee. The Committee had ruled in favour of the employee, declaring the extraordinary termination of the employment contract void and awarding compensation to the employee. However, the client disagreed with the decision, as did Harju County Court.

Harju County Court found that all substantive and procedural requirements for terminating the employee’s employment contract on the grounds of redundancy had been met, including a demonstrated reduction in workload and organisational restructuring. The employee did not meet the requirements of the new position created as a result of the restructuring, and as there were no other vacant positions available, the employer was not obliged to offer the employee alternative employment.

Consequently, the employee’s claim was dismissed in its entirety, and the employee was ordered to reimburse Introduct Estonia OÜ for its procedural costs.
