RASK represents developer in dispute over detailed plan amending a comprehensive plan.

Case

In April 2020, the local government approved a detailed plan initiated on the basis of a developer’s application. The detailed plan amended the existing comprehensive plan by changing the principal purpose of land use established by the comprehensive plan so that part of the recreational land was converted to residential land for small dwellings.

An action has been filed with the administrative court to repeal the decision to approve the detailed plan. According to the applicants, there was no justified need to amend the comprehensive plan and no corresponding public interest in the matter. The applicants also maintain that, given the location of the planning area in a green infrastructure corridor, the implementation of the detailed plan would have a significant negative impact on the functioning of the entire green network.

RASK attorney-at-law Villy Lopman represents the interests of the developer, who was brought in as a third party in the dispute by the court.
